Terms of Service

These Terms of Service ("Terms") govern your access to and use of SmartFireAlerts (the "Service"), operated by SmartFireAlerts ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

SmartFireAlerts provides wildfire monitoring, smoke exposure estimates, weather data, and risk analysis tools intended for vineyard operators and agricultural users in California. Data is sourced from third parties including NASA FIRMS, NOAA GOES, NIFC, and OpenWeather.

2. No Guarantee of Safety

The Service is an informational tool, not an emergency service. Satellite fire detections can be delayed, inaccurate, or missed entirely. Weather forecasts and simulation outputs are estimates and may be wrong. You must not rely on the Service as the sole basis for evacuation, firefighting, or any life-safety decision. In an emergency, contact 911 and follow instructions from official agencies such as CAL FIRE and local authorities.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and notify us at info@smartfirealerts.com if you suspect unauthorized access.

4. Subscriptions and Payment

Paid plans are billed in advance on a monthly or annual basis through our payment processor. Fees are non-refundable except where required by law. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Prices are listed on our Pricing page and may change with 30 days' notice.

5. SMS and Email Alerts

If you opt in to SMS or email alerts, you consent to receive messages from us at the phone number or email address you provide. Message and data rates may apply. You can opt out of SMS alerts by replying STOP to any message, and from email alerts via the unsubscribe link in any email. See our Privacy Policy for details on how we handle contact information.

6. Acceptable Use

You agree not to:

• Scrape, redistribute, or resell data obtained from the Service without our written permission;
• Use the Service to harass, defraud, or harm others;
• Attempt to circumvent rate limits, authentication, or other security controls;
• Use the Service in violation of any applicable law or third-party rights.

7. Intellectual Property

The Service, including its software, design, and aggregated data products, is owned by SmartFireAlerts and protected by copyright and other laws. Underlying source data remains the property of the original data providers (NASA, NOAA, NIFC, OpenWeather, Mapbox, etc.) and is subject to their respective terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTFIREALERTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, PROPERTY, OR CROPS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason upon reasonable notice. You may close your account at any time by contacting us.

11. Changes

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California.
